There are some exceptions to the time limits; however, these pertain mainly to minors (under the age of 18 at the time of the accident), brain/mental damage and injuries that only show the severity of the damage years later. 

11. My child was under the age of 18 when the accident happened. Does the 3-year time limit still apply?

Personal injury claims are required to be made within 3 years of the incident; however, a child under 18 years of age can be an exception.

12. Can you claim from PRASA without a lawyer?

If you’ve been seriously injured in an accident on PRASA property, you may be able to file a claim in Small Claims Court without hiring an attorney. 13. What injuries does PRASA compensate for?

15. Can PRASA reject a claim?

If the accident and injuries were due to your own actions, for example, you tried to board a moving train or stood between coaches while the train was moving, PRASA may reject the claim, and it will then be presented to the court. A judge will then decide whether or not you have a valid claim based on the circumstances and evidence produced.

16. Does PRASA pay for pain and suffering?

Yes, people involved in train accidents can also claim general damages for pain, suffering and loss of amenities of life, such as being physically or mentally impaired.

17. What affects the pay out amount for a PRASA claim?

This is dependent on a number of varying factors, such as:

18. Are there any PRASA claims you do not deal with?

20. My child was killed in a train accident. Can I claim from PRASA?

Unfortunately, PRASA makes no allowance for a claim for the death of a minor, which is a child under the age of 18, nor for an unborn child. Adendorff Attorneys Inc. does not assist with funeral claims.

21. Can I claim for the death of my spouse?

It is very difficult losing your partner, let alone the breadwinner of the household. Should a train accident result in your spouse’s death, you as the husband/wife can claim for loss of financial support. Adendorff Attorneys Inc. does not assist with funeral claims.

22. Can I claim for the death of my parents or guardian?

The loss of a parent/guardian is very hard on any young child, emotionally and even financially for them and other family members. Should a train accident result in your parent/guardian’s death, a family member can claim for funeral costs and loss of support if the child is under the age of 18. 23. Do you deal with claims from PRASA, Metrorail and Gautrain?
