The North Gauteng High Court awarded an impressive settlement of R8,781,900.00 to a client of the personal injury law firm, Adendorff Attorneys Inc., in September 2021. A Cape Town family approached Adendorff Attorneys Inc. for assistance in a personal injury claim against the Road Accident Fund. Jurie Terblanche, a senior associate at Adendorff Attorneys Inc., met with the family of 17-year-old Fezile Makeba*, a grade nine pupil.

The family shared that Fezile had been hit by a taxi while standing on a pavement and had been left with severe head injuries. Fezile had no recollection of how he got to Tygerberg Hospital after the incident. His first memory was waking up in the hospital.

Life After The Accident

Fezile’s medical team raced to save his life. However, tests revealed that he had suffered a severe closed head trauma. Adendorff Attorneys Inc. helped the family obtain the medical records when we took on the case. 

Fezile saw many different medico-legal specialists. The neurologist, diagnosed permanent severe neurocognitive compromise and could not return to school. He confirmed that the youth had been left with poor to no concentration span. He is forgetful; he has altered emotions, behaviour and personality, struggles to understand verbal and written instructions and needs support and assistance for the rest of his life. He has also not been able to be employed since the accident.

Calculating the Personal Injury Claim

Adendorff Attorneys Inc. also referred Fezile to a psychiatrist, speech and language pathologist, clinical psychologist, educational psychologist, and occupational therapist. An industrial therapist, forensic merits investigator, and actuarial scientist also helped identify the “quantum”, the amount that Fezile should be paid out due to the proven claim.

At the trial, the judge granted a capital amount of R8,781,900.00 which was split up into, general damages, past medical expenses, past and future loss of earnings and earning capacity.
